The Company strives to discover and develop first-in-class and best-in-class medicines-advancing a diverse portfolio of large and small molecules.Job Summary (Primary function)The Associate Director Corporate Counsel, Privacy works closely with internal business partners to understand business processes, applications, projects, and technologies and help embed privacy and data protection requirements and controls into contracts, projects, products, and services. The Assoc. Director reports in to Incytes Global Privacy Officer.Essential Functions of the Job (Key responsibilities)Counsel and support the Company on privacy and data protection issues in connection with the development and implementation of technology, processes, products, and services.Advise on the requirements of, and compliance with, global and local privacy and information security laws, regulations, controls and standards (including but not limited to: GDPR, HIPAA, CCPA/CPRA).Possess background in pharmaceutical research and development programs and processes, including Pharmacovigilance, Clinical Development Operations, Medical Affairs, Market Research, Translational Sciences, Early Phase Development, etc.Assist internal business units with contract template management for applicable data processing terms and agreements.Review, draft, and negotiate data processing agreements and terms. Assist with the review, drafting and negotiation of data processing agreements and terms.Lead contract and privacy assessment remediation processes.Help maintain training materials including instructions, guidelines and FAQs.Assist Global Privacy Officer, regional Data Protection Officers, and Information Security Officer with cybersecurity and data breach incident response as assigned.Assist with data protection notice language review for websites, forms, and projects.Assist with preparation and review of data protection notice language associated with consent forms for clinical trials, observational/non-interventional research, market research/surveys, etc.Conduct legal evaluation of privacy assessments as per Incyte processes and as required by relevant data protection laws (ie: GDPR).Coordinate with outside counsel globally to advise clients on privacy matters.Monitor current and evolving global and local laws, regulations, and case law and help to identify legal issues of critical importance to the company.Work closely with and support the Global Privacy Officer, Information Security Officer, regional Data Protection Officers, and Region Europe Legal colleagues on other privacy initiatives.Liaise with internal Audit for contracting and processes on behalf of the Privacy program and provide assistance with audits as requested.Qualifications (Minimal acceptable level of education, work experience, and competency)J.D degree as well as membership in good standing in at least one state bar.A minimum of 5 years of applicable law practice experience.Good general working knowledge of data protection laws, liability issues, contract preparation and negotiation.Knowledge of data classification, data mapping and data management methodologies (a plus)Certified Information Privacy Professional (CIPP) or other related certification preferred or ability to take exam within 6 months of start date.Strong written and verbal communications skills, including the ability to communicate concisely to clients.Ability to manage multiple tasks simultaneously and to flourish in a fast-paced environment.Excellent organization, project management, and prioritization skills Extraordinary attention to detail High level of professionalism, integrity and ability to maintain confidences while working with sensitive, confidential information.Disclaimer: The above statements are intended to describe the general nature and level of work performed by employees assigned to this job.
